Welcome to Spend Savvy. These Terms of Use ("Terms") govern your access to and use of the Spend Savvy mobile application, website, web application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.
1. Acceptance of These Terms
By creating an account, accessing, or using Spend Savvy, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
If you do not agree with these Terms, do not use the Service.
2. Eligibility
You must be legally capable of entering into an agreement under the laws applicable to you. If you are using Spend Savvy on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.
Spend Savvy is not directed to children. You should not create an account or use the Service if you are not permitted to do so under applicable law.
3. Your Account
Account information
You are responsible for providing accurate information when creating or maintaining your account and for keeping your login credentials secure.
Account security
You are responsible for activity performed through your account unless the activity resulted from circumstances outside your reasonable control. Notify us promptly if you believe your account has been accessed without authorization.
Account deletion
You may request or initiate deletion of your Spend Savvy account using the account-deletion functionality provided in the Service. Deletion may permanently remove account information and associated data, subject to applicable legal, security, fraud-prevention, or backup-retention requirements described in our Privacy Policy.
4. Acceptable Use
You agree not to:
- Use the Service for unlawful, fraudulent, abusive, or unauthorized purposes.
- Attempt to gain unauthorized access to the Service, another user's account, or related systems.
- Interfere with, disrupt, reverse engineer, or circumvent security or technical controls of the Service, except where applicable law expressly permits it.
- Upload malicious code or content intended to damage or disrupt the Service.
- Use automated methods to scrape, copy, overload, or systematically extract data from the Service without authorization.
- Misrepresent your identity or use the Service in a way that infringes another person's rights.
5. Your Data and Content
You may enter information such as income, expenses, categories, budgets, savings goals, challenges, notes, and other personal financial information into Spend Savvy ("User Content").
You retain your rights in your User Content. You grant Spend Savvy the limited rights necessary to host, process, synchronize, secure, display, back up, and otherwise provide the Service you request, subject to our Privacy Policy.
You are responsible for the accuracy of information you enter. Spend Savvy does not independently verify your transactions, balances, categories, or financial records.
6. AI-Powered Features
Spend Savvy may offer optional AI-powered features, including spending analysis, natural-language assistance, categorization, summaries, or recommendations.
Where required, financial or other personal information is sent to a third-party AI provider only after the applicable in-app AI disclosure and consent process has been completed. Our Privacy Policy explains the information involved and how it is processed.
AI features are not a substitute for professional financial, investment, tax, legal, accounting, or other professional advice.
7. Financial Information and No Professional Advice
Spend Savvy helps you record and understand your own financial information. The Service may calculate totals, trends, budgets, charts, reports, or other insights based on information you provide.
Nothing in Spend Savvy constitutes financial, investment, tax, accounting, legal, lending, credit, or other professional advice. Spend Savvy does not guarantee that any budgeting suggestion, calculation, insight, or recommendation is suitable for your circumstances.
You remain solely responsible for financial decisions you make based on information displayed by the Service.
8. Third-Party Services and Links
The Service may rely on or integrate with third-party services, such as authentication, cloud infrastructure, analytics, advertising, app stores, and optional AI services. Your use of those services may also be subject to their own terms and policies.
We may provide links to third-party websites or services. We do not control those third parties and are not responsible for their content, availability, policies, or practices.
9. Intellectual Property
The Service, including its software, design, branding, graphics, text, interfaces, and other materials provided by Spend Savvy, is owned by or licensed to Spend Savvy and is protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.
You may not copy, reproduce, distribute, sell, lease, modify, or create derivative works from the Service or its proprietary materials except as permitted by law or with our written permission.
10. Service Availability and Changes
We aim to keep Spend Savvy available and reliable, but we do not guarantee that the Service will always be uninterrupted, error-free, secure, or available at every time or location.
We may modify, suspend, discontinue, or add features to the Service. We may also release updates or changes that are necessary for security, legal compliance, compatibility, or product development.
11. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, except where a warranty cannot legally be excluded.
We do not warrant that:
- the Service will meet every individual requirement;
- calculations, classifications, reports, or AI-generated information will always be accurate or complete;
- the Service will be continuously available or free of defects; or
- using the Service will result in any particular financial outcome or amount of savings.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Spend Savvy and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or financial opportunity arising from or related to your use of the Service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
13. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary to protect the Service, other users, our systems, or to address violations of these Terms or applicable law.
Where appropriate and legally permitted, we may provide notice before taking action. Provisions that by their nature should survive termination, including intellectual-property, disclaimers, limitations of liability, and dispute-related provisions, will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. When material changes are made, we may provide notice through the Service or other reasonable means. The updated Terms will become effective on the stated effective date.
Your continued use of the Service after the effective date means that you accept the updated Terms to the extent permitted by applicable law.
15. Governing Law and Disputes
These Terms are intended to be interpreted under the laws applicable to the relationship between you and Spend Savvy, subject to any mandatory consumer-protection or other laws that apply to you.
If a dispute arises, the parties should first attempt to resolve it through good-faith communication. Any formal dispute-resolution process will be subject to applicable law and the rights available in your jurisdiction.
